judge lacked authority to order Mahmoud Khalil’s release.
Background
Khalil, an Algerian national, faced deportation after
his green card was revoked for failing to
disclose extremist views and associations.
His case stalled when Judge Michael Farbiarz
intervened and ordered his release in June.
Appeals Decision
In a 2–1 ruling, the court said Farbiarz
“never had proper jurisdiction”to hear the habeas petition.
Judges wrote that immigration law requires
such cases to remain in the immigration court system.
Impact
The decision voids the release order and allows ICE to re-detain Khalil.
While his lawyers plan to appeal, critics say the case reflects
